Conditions of Purchase

This contractual document shall govern the purchase of books and editorial publications in physical format (non-perishable) through the website enciclopediaart.cat/, owned by ENCICLOPÈDIA CATALANA, SLU, hereinafter the PROVIDER.

These Conditions shall remain published on the website and available to the USER for reproduction and storage as confirmation of the contract, and may be modified at any time by the PROVIDER. It is the USER’s responsibility to read them periodically, as those in force at the time of placing the order shall apply. Acceptance of this document implies that the USER:

  • Has read, understands and comprehends what is stated herein.
  • When placing an order through this website, declares to be over 18 years of age and to have legal capacity to contract.
  • Assumes all obligations set forth herein.
  • These conditions shall have an indefinite period of validity and shall apply to all contracts entered into through the PROVIDER’s website.

Identity of the Contracting Parties

And on the other hand, the USER, identified during the purchase process through the data provided (e.g., name, surname, email address, billing and/or shipping details). It is not necessary to create a user account in order to purchase.

Purpose of the Contract

The purpose of this contract is to regulate the contractual relationship of sale arising between the PROVIDER and the USER at the moment when the USER accepts these conditions during the online contracting process.

The contractual relationship entails the delivery, in exchange for a specific price publicly displayed on the website, of one or more books.

The language in which the contract may be concluded through this Website is Catalan, Spanish or English (depending on the website configuration).

Contracting Procedure

To make a purchase, the USER:

  • Selects the book and adds it to the cart.
  • Enters the necessary billing details and, where applicable, shipping details (including any tax identification that may be required for issuing an invoice and/or tax/customs requirements).
  • Views the order summary, including the book price, applicable taxes, shipping costs and, where applicable, additional charges calculable prior to payment.
  • Accepts these Conditions and confirms the “order with obligation to pay”.
  • Makes the payment using the available payment methods.

The personal data provided during the purchase process shall be processed in accordance with the GDPR and applicable regulations, as indicated in the Legal Notice and Privacy Policy of the website.

The PROVIDER makes available to users technical means to identify and correct errors in the data entered into the forms, allowing their review before confirming the purchase.

General Contracting Clauses

Unless otherwise stipulated in writing, placing an order with the PROVIDER shall imply acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER unless expressly accepted in advance and in writing by the PROVIDER.

To place an order, the USER must follow the online purchase procedure and accept these General Terms and Conditions of Purchase in the section confirming the purchase with obligation to pay.

Order Shipment

The PROVIDER shall not ship any order until it has verified that payment has been made (or, in the case of bank transfer, until effective receipt/confirmation of funds).

Shipments are made through a single transport company selected by the PROVIDER, and shipping costs are calculated automatically based on destination and other logistical parameters (e.g., weight/volume) and displayed before completing the purchase. Shipping costs are not included in the price of the book and are charged separately.

The delivery period shall vary depending on the destination country and shall be displayed (where possible) as an estimated period during the purchase process. In any case, if no other period has been agreed, the general delivery framework provided under applicable consumer regulations shall apply.

The PROVIDER shall not assume any liability when delivery is not completed due to false, inaccurate or incomplete data provided by the USER.

Delivery shall be deemed completed when the carrier has made the product available to the USER and the USER (or authorized person) has accepted receipt.

t is the USER’s responsibility  to check deliveries upon arrival, make any observations and submit any claims deemed appropriate. The USER may even refuse the package if it appears to have been opened or shows clear signs of damage. These observations or claims must be sent to the transport company.

Territorial Scope of Shipments

The PROVIDER offers international shipping, except to:

  • Cuba, and
  • countries or territories in situations of armed conflict, under restrictions or sanctions, or where transport is not viable due to operational or legal reasons.

In case shipment to the selected destination is not possible, the system will indicate this during the purchase process or the PROVIDER will contact the USER.

Customs, Import Taxes and Other International Charges

For shipments outside the applicable customs territory (e.g., outside the EU), the order may be subject to import duties, local taxes and/or customs handling fees.

When the system can calculate and display these charges before payment, they shall be included in the final total of the purchase.

All foreseeable customs expenses shall be shown at the time of purchase and shall be borne by the USER. All unforeseeable customs expenses shall be borne by the SELLER.

Price and Validity Period of the Offer

The prices on the WEBSITE are expressed in euros.

The prices indicated for each product include applicable taxes, unless expressly stated otherwise. Prices do not include shipping costs, which shall be calculated and displayed before completing the purchase.

The SELLER reserves the right to modify prices at any time, but orders shall be charged at the price in force at the time of order confirmation.

Payment Methods

The PROVIDER enables the following payment methods:

  • Debit/credit card via Banco Sabadell payment gateway (virtual POS).
  • Bank transfer (instructions will be provided during the purchase process or in the order confirmation).

Security measures: the website uses standard e-commerce security measures (e.g., SSL/TLS encrypted connection) and, in card transactions, payment data is managed through the banking gateway, without the PROVIDER storing the complete card details.

Purchase Process

Any book in the catalogue may be added to the cart. During the checkout process, the USER will be able to see:

  • product(s) and quantity,
  • price of the book(s),
  • applicable taxes,
  • automatically calculated shipping costs,
  • and the final total before confirming the purchase.

Once the order has been processed, the system will send an email to the USER confirming the placement of the order and, where applicable, its status.

Right of Withdrawal

The USER has a period of fourteen (14) calendar days from the date of receipt of the book to exercise the right of withdrawal, without stating the reason and without incurring any cost other than those legally provided.

To exercise withdrawal, the USER must notify the PROVIDER through the contact channels indicated in these conditions, indicating the order number and the necessary data to identify the purchase.

It shall be sufficient to send your notification before the end of the 14-day withdrawal period and return the Product to:

The SELLER does not assume ownership of the returned Product until it has been received, within the indicated period, at ENCICLOPÈDIA’s address.

The Customer shall bear the return transport costs. Only the cost of the product is refundable (shipping costs are not included). The time to receive an exchanged product may vary depending on the USER’s place of residence.

Exception (customized products)

If the book is dedicated and/or personalized at the USER’s request (for example, with a nominative dedication or specific personalization), the right of withdrawal may not apply under the terms provided for clearly personalized goods.

The USER shall bear the direct costs of returning the Products and shall be responsible for any reduction in the value of the returned goods resulting from handling of the Products (except where such handling was necessary to determine the nature and characteristics of the Products).

The right of withdrawal does not apply, in accordance with current regulations, when the Product has been handled, shows signs of use or reading, is damaged, personalized, altered or not suitable for resale.

Returns for Lack of Conformity and Warranty

The PROVIDER guarantees that the books offered are original and correspond to the description published on the website. For signed copies, the product sheet shall indicate the nature of the signature and, where applicable, the documentation or proof of authenticity included.

ENCICLOPÈDIA has made every possible effort to display the colors of the Products as faithfully as possible to reality. However, the colors displayed on the WEBSITE screen may vary depending on the quality of the USER’s monitor. In this respect, the SELLER cannot guarantee that the colors shown on the monitor will be exactly the same as the real ones.

The sale of books is subject to the legal warranty of conformity provided under consumer regulations. In general terms, the legal warranty period is three (3) years from delivery for new goods (without prejudice to specific regimes where applicable). To make use of the warranty, the purchase invoice must be presented, which will be included with the shipment of the order. The warranty does not cover travel costs or defects caused by impacts, scratches, improper use or normal wear of materials.

In case of lack of conformity, the USER may exercise the rights provided under applicable law (repair, replacement, price reduction or termination), in accordance with legal requirements and limits. Termination of the contract shall not proceed where the lack of conformity is of minor importance, in accordance with current regulations.

Force Majeure

ENCICLOPÈDIA shall not be responsible for any delay or failure to perform its obligations when such delay or failure is due to circumstances beyond its reasonable control, including, without limitation:

– Natural disasters

– Wars, terrorism or civil disturbances

– Strikes or labor disputes

– Government actions or regulations

– Failures of public services or telecommunications networks

– Pandemics or health emergencies

In such cases, the SELLER’s obligations shall be suspended for the duration of the force majeure event. If the event lasts more than 30 days, either party may terminate the contract, and the USER shall be entitled to a full refund.

Assignment

The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.

If any provision of these conditions is considered null or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected.

The USER declares having read, understood and accepted these General Terms and Conditions in their entirety.

Applicable Law and Jurisdiction

These conditions shall be governed and interpreted in accordance with Spanish law in matters not expressly established herein.

Any action brought by the USER against the PROVIDER may be filed before the courts having jurisdiction in accordance with applicable consumer protection and judicial competence regulations.

If the USER has their domicile outside Spain, the PROVIDER and the USER shall submit to the forums applicable under current private international law and judicial competence regulations.
